Terms and Conditions

These Terms and Conditions ("Terms") are a binding agreement between you ("Customer," "you") and Sun Painting Virginia ("Sun Painting," "we," "us," or "our"). They govern your use of the customer portal at https://estimating.sunpaintingva.com (the "Service") and any painting work, estimates, change orders, invoices, or related services we provide to you.

By creating or signing into a customer account, signing an estimate or change order, or accepting work performed by Sun Painting, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to enter into a legally binding contract to use the Service.

Customer accounts are created automatically when you sign your first estimate. The portal uses magic-link authentication: a single-use sign-in link is emailed to the address on file each time you log in. You are responsible for keeping your email account secure and for any activity that occurs under your account.

If you suspect unauthorized access to your account, contact us at support@sunpaintingva.com immediately.

Estimates describe the scope of work, materials, pricing, and any project-specific terms. Unless stated otherwise on the estimate itself, estimates are valid for sixty (60) days from the date issued.

An estimate becomes a binding agreement when signed by the Customer, either electronically through the portal or in writing.

Scope. Sun Painting will perform only the work described in the signed estimate. Any work beyond that scope — including changes in surfaces, colors, materials, or repair work uncovered during the project — will be quoted and confirmed through a written change order before that work is performed.

Discoveries during work. If, after starting, we encounter latent conditions (such as hidden rot, mold, lead paint, or substrate damage), we will pause and quote those items separately. The original schedule may shift to accommodate this work.

Prices are stated on the estimate or change order. Unless otherwise specified:

• A deposit may be required to schedule a project; the deposit amount will be listed on the estimate.
• Invoices for completed work are due within fifteen (15) days of issuance.
• Past-due balances may accrue a late fee of 1.5% per month (or the maximum allowed by law, whichever is lower).
• Returned-payment (NSF) fees may be passed through to the Customer.

Payments processed online are handled by our third-party payment provider. Sun Painting does not store full payment card numbers on its servers.

If a balance remains unpaid more than thirty (30) days after the due date, Sun Painting may suspend further work, pursue collection, and recover reasonable collection costs and attorneys' fees permitted by law.

The Customer agrees to:

• Provide safe and reasonable access to the job site during agreed-upon working hours.
• Remove or relocate personal items, fragile objects, and breakables from work areas, unless we have agreed in writing to handle this.
• Disclose known hazards on the property (electrical, structural, pests, lead paint, asbestos, etc.).
• Provide reasonable access to water and power needed to perform the work.
• Approve color selections and finishes by the deadlines noted on the estimate or schedule.

Schedules are estimates and may be affected by weather, supply availability, or discoveries during work. Sun Painting will provide reasonable notice of material schedule changes.

You may cancel a signed estimate in writing before work begins. If materials have been ordered, scheduled, or custom-mixed prior to cancellation, you remain responsible for the cost of those materials and any non-refundable scheduling charges.

Sun Painting may cancel or withdraw from a project if the site is unsafe, if a material fact was misrepresented, if access cannot be obtained as agreed, or if amounts due are not paid. In such cases, you will be invoiced for work performed and materials supplied to date.

Sun Painting warrants its workmanship against defects (such as peeling, blistering, or excessive cracking attributable to application errors) for the period stated on your signed estimate. If no period is stated on the estimate, the default workmanship warranty is two (2) years from the completion date for exterior work and three (3) years for interior work.

The warranty does not cover:

• Failures caused by substrate movement, structural defects, water intrusion, or moisture from outside the painted system.
• Normal wear, fading, chalking, or color changes due to UV exposure.
• Damage from impact, abuse, pressure washing, abrasive cleaning, or third-party work performed after our project.
• Surfaces or materials specifically excluded on the estimate, or work the Customer declined to have us perform.
• Bleed-through from tannins, knots, water stains, smoke, or prior coatings that we noted but the Customer declined remediation for.

To make a warranty claim, contact us in writing at support@sunpaintingva.com within the warranty period and provide a description and photos. Our sole obligation under this warranty is to re-perform the defective workmanship.

Except for the workmanship warranty in Section 7, the Service and all painting services are provided "as is" and "as available." To the maximum extent permitted by law, Sun Painting disclaims all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.

Color samples, drawdowns, and digital renderings shown in the portal are approximations. Actual finished colors and sheens vary based on lighting, substrate, and material lot. We recommend approving large drawdowns on-site before production application.

To the maximum extent permitted by law, Sun Painting will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of use, arising from or related to the Service or the painting work, even if advised of the possibility of such damages.

Sun Painting's total cumulative liability for any claim arising from the Service or the project is limited to the total amount you actually paid Sun Painting for the project giving rise to the claim.

Nothing in this section limits liability that cannot be limited under applicable Virginia law, including liability for personal injury caused by negligence.

Sun Painting carries general liability and workers' compensation insurance as required by Virginia law. Certificates are available on request.

Sun Painting may use vetted subcontractors to perform portions of the work. Sun Painting remains the Customer's point of contact for the project.

By providing your email address and mobile number, you consent to receive transactional and service-related communications from Sun Painting through email, phone, and text message. Our SMS messaging is delivered through a registered A2P 10DLC messaging service and is used for estimates, change orders, scheduling, reminders, and payment notifications related to your project.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages at any time, or HELP for assistance. For customer care, email support@sunpaintingva.com. Full details are in our Privacy Policy.

The Sun Painting software platform and mobile apps are owned and operated by Sun Painting Virginia. All SMS messages are sent by or on behalf of Sun Painting Virginia, and SMS consent collected through the platform applies only to Sun Painting Virginia's messaging program.

Mobile carriers are not liable for delayed or undelivered messages.

You agree that electronic signatures, electronic estimates, and electronic change orders are legally binding and have the same effect as a signed paper document.

The Service, including its software, design, text, and graphics, is owned by Sun Painting or its licensors and is protected by copyright and other laws. You may use the Service only to manage your own projects with Sun Painting. You may not copy, scrape, reverse-engineer, or resell the Service.

Sun Painting may take photos of completed projects for portfolio and marketing use. We will not include personally identifying information (such as your name or address) with those photos without your written permission. You may opt out of portfolio photography by emailing support@sunpaintingva.com.

Sun Painting may suspend or terminate access to the Service if you violate these Terms, if your account is inactive for an extended period, or if continued access creates a security risk. Termination of portal access does not, by itself, terminate any unpaid invoice or active project agreement.

These Terms and any dispute related to the Service or a Sun Painting project are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. The parties agree to attempt in good faith to resolve any dispute by direct discussion before initiating legal action.

Any unresolved dispute will be brought exclusively in the state or federal courts located in Virginia, and each party consents to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. Material changes will be communicated through the customer portal or by email. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
